Plovdiv, Plovdiv Blvd. “Vasil Aprilov” № 91 floor 1 app.1, registered in the Commercial Register of the Republic of Bulgaria with UIC 204872610.

Policies

When you make a reservation, you accept the applicable policies that appear in the reservation process. You will find the cancellation policy and all other policies (for age requirements, security/damage deposits, add-ons for group bookings, extra beds, breakfast, pets, cards accepted, etc.) of each service provider on our platform: on the service provider information pages, during the booking process, in the fine print text, and in the confirmation email or certificate (if applicable).

If you cancel a booking or do not show up, cancellation/no-show fees and refunds will depend on the relevant service provider’s policies.

Some bookings cannot be cancelled free of charge, while for others this can only be done before a certain deadline.

If you book a travel product by paying in advance (including all components of the price and/or a damage deposit, if applicable), the service provider may cancel the booking without notice if it does not receive the amount on the specified date. In such event, any non-refundable payments made by you will be refunded at its sole discretion. You are responsible for ensuring that payment is made on time (your bank or debit/credit card details must be correct and there must be sufficient funds in your account)

If you don’t think you will get there on time, contact the service provider and let them know when to expect you. It is your responsibility to arrive on time – and if you fail to do so, we are not responsible for the costs involved (e.g. cancellation of your booking or any fees the service provider may charge you).As you are the person making the booking, you are responsible for the actions and behaviour (in relation to the travel product) of everyone in the group. You are also responsible for obtaining their consent before providing us with their data.

Concepts

PLATFORM: Represents the www.dmcworld.bg website or other websites owned by DMC World, mobile applications and booking tools operated by DMC World.

PROFILE: Represents a profile (in DMC World or another company of the group) through which you can book a travel product on our platform.

TERMS AND CONDITIONS: These are the current rules for the service

TOURIST PACKAGE CONTRACT: In the case of a tourist package within the meaning of the Tourism Act, these General Terms and Conditions, together with the specific conditions provided to the USER with the offer for the tourist package, and accepted by the USER by booking this service under these conditions, constitute a tourist package contract.

USER/CUSTOMER: Any natural or legal person who uses the platform or anyone who makes a reservation

TRANSFER: is a type of transportation service, which is where the User/Customer travels from a location designated by him/her to a location designated by him/her with special conditions

RIDER: is any natural person who intends to use the transport services booked through the Platform, who may be a User.

TRAVEL: means the various travel products and services that may be ordered, received, purchased, paid for, hired, provided, booked, combined or consumed by you and offered by the Trip Provider

TRAVEL BOOKING: means the ordering, purchase, payment or booking of a Trip.

TOURIST PRODUCT: Means one of the travel-related products or services on the Platform.

SERVICES: Include, but are not limited to, corporate services, event organization, such as conferences, symposiums, seminars, gala dinners, hotel accommodations, team building, car rental with/without driver, individual tours and vacations, special personal events such as birthdays and weddings, airline ticket booking, travel insurance and much more.

PACKAGE SERVICE: Booking of two or more tourist services

SERVICE PROVIDER: This is the provider of a travel-related product or service on the Platform, including but not limited to: the owner of a hotel or other accommodation (for booking accommodation), or a car rental company/airline (for booking transport).

INTERVENTOR: This is a third party provider of a travel product or service, e.g. airline, hotel, etc.

BOOKING: This is a reservation for a travel product or service on our platform, whether it is through the website, by phone or email. Upon completion of the booking, you accept and agree to all the terms and conditions that are provided to you, at the time of booking. All bookings are made on a “request – confirmation” basis.

PRICING: When you make a reservation, you agree to pay the price of the travel product or service, including all fees and taxes that may be applicable. The price is not guaranteed until confirmed in writing and is subject to change in the event of subsequent situations such as – fuel price increases, tax and fee increases, force majeure, etc. All fares are net.

PAYMENT:

Payment method – by bank transfer, via Strype or in cash at DMC World offices

Auton prepayment is required upon confirmation. The amount of the advance payment is determined by various conditions such as – season, number of clients, period of booking and are detailed in the contract between the Client / User and the Supplier / Intermediary. If we do not receive payment within the stipulated terms, the booking will be cancelled unless otherwise stated.

Cancellation fees for individual and group bookings: unless otherwise stated – Cancellation fees are not charged by us, but by our hotels and contractors. If the reservation/service is cancelled within 60 days prior to the group’s scheduled arrival date, cancellation is free. If we receive a cancellation less than 60 days from the arrival date, the hotels and subcontractors charge us depending on the circumstances and dates of travel. This amount will be charged to you accordingly and deducted from the advance paid. During special events and periods ( exhibitions, high season, public holidays) other cancellation rules apply as described below under Cancellation Fees.

CHANGES, CANCELLATIONS AND CHARGES: This is a change or cancellation of a reservation already made for accommodation, transfer or other service. All bookings, changes to bookings already made and cancellations must be sent and confirmed by us by email.Some bookings cannot be cancelled free of charge and others can only be cancelled within a certain deadline. Unless otherwise stated, between the general and specific cancellation fee conditions, the specific ones will apply.

CURRENCY: All payments will be made in Euros, US Dollars or Bulgarian Leva. The amount that your credit card will be charged is obtained by converting the price from Euro/US Dollar/other currency to Bulgarian Leva according to the current exchange rate of the Bulgarian National Bank on the date of conversion. When you charge your credit card, the same amount is converted into your local currency according to the credit card association’s exchange rate. As a result of this conversion, there may be a slight difference from the original price stated on our website or promotional materials. All exchange rate charges and all bank charges ( in case of payment by bank transfer, stripe) are at your expense.

COMPLAINTS: All inquiries and complaints are recorded and handled with high priority.Any complaints must be submitted by the customer/user directly to office@dmcworld.bg. and must be described in detail and accompanied by all possible and available documents related to the situation. DMC World will assist you as much as possible to resolve the complaint. Complaints submitted after the event has concluded will not be considered.

LIABILITY: DMC World is not responsible for any event that is beyond our control. We are not responsible for injury to any person due to unavoidable accidents or accidents caused by a third party, loss or damage to personal belongings. We make no promises about the products and services of service providers except as expressly set out in these Terms. If you are in breach of these Terms or the service provider’s terms, we will not be liable for any costs you incur as a result.

FORCE MAJEURE: These are “unforeseen circumstances”, (events) of an extraordinary nature, which occurred after the conclusion of the contract, could not have been foreseen and do not depend on the will of the parties such as: fire, industrial accidents, military actions, natural disasters – storms, heavy rains, floods, hail, earthquakes, ice, drought, landslides, etc. natural disasters, embargoes, government bans, strikes, riots, disturbances, etc. In emergency situations, we consider bookings on a case-by-case basis and identify those that qualify as force majeure. DMC World has the right to cancel a booked event or service in the event of unexpected weather conditions or other force majeure circumstances beyond our control that are relevant to the realisation of the event. If there is a prepayment, part or the full amount may be refunded, depending on the conditions, timeframe and reasons why this is necessary.

Booking method – via the platform, by email, by phone or on-site at the DMC World office.

Each reservation/booking request is forwarded by DMC World, on behalf of the user, to the relevant Supplier in the form of a request.

Booking of hotel accommodation

The reservation is considered complete when the user receives an e-mail message to the e-mail address provided by the user confirming the reservation, the amount due has been paid and the hotel voucher has been issued.

Pricing – Hotel accommodation rates are provided by a third party supplier and are determined by season, availability and event capacity.

Payment – when booking a hotel, the payment terms are set by a third party supplier, which we as an intermediary will acquaint you with in detail and with which you agree after signing a contract and advance payment.

In cases where the booking is in a “non-refundable” status (the penalty is 100% at the time of confirmation), and immediate payment of the full amount of the booking is required.

In the event that the client has not made payment or has breached the payment terms, DMC World has the right to cancel the booking without the client’s consent. In this case, DMC World shall not be liable to the customer and shall not be liable for any compensation or penalty

In the event that circumstances arise which prevent DMC World from performing the requested services within the time specified for reasons beyond DMC’s control, DMC World may, without the consent of the customer and without liability, make the following changes which the customer agrees do not constitute a material change to any provision of the contract:

To change the hotel in which the client is staying to a hotel of the same category or higher, under the same conditions of accommodation and at the same boarding house; In these cases DMC is not liable to the client and does not owe compensation or penalties.

The final price of the reservation applies to the number, type of rooms and period of accommodation you have selected and generally does not include local taxes. These charges are payable by the customer at the hotel reception. The boarding rate is indicated for each specific reservation. Where breakfast, lunch or dinner is included in the price it is explicitly mentioned. Where it is possible to request a meal at an additional cost, this is stated on the booking request itself.

Changes, including cancellation of an already issued hotel reservation, can only be made if this possibility is provided for in the terms and conditions of the service provider. Please note that if such changes are possible, they may involve the payment of additional charges

Any cancellation of a specific reservation must be made in writing

The category of hotels is determined according to the legislative specificities of the respective country. The information on the facilities and services offered by each hotel is provided by the hotels themselves at the time of inclusion in the reservation system and DMC World shall not be held liable for any discrepancy with the information previously declared about them.

Clients should note that check-in at hotels is generally after 3 pm. Check-out after the last night is until 11 pm. If you expect to check in at your chosen hotel late in the evening (after 10 pm), you should contact the hotel and personally inform the reception. All advertised times are local to the destination.

DMC World is not responsible for any problems related to the accommodation of pets, if not specified in writing during the booking process

In the event of damage to the hotels used, the specific perpetrator or perpetrators shall assume material responsibility for the damage, including on the spot, when requested to do so by the victim. DMC World does not bear any costs in this procedure and does not owe any compensation or indemnity in the event of any change in the schedule and content of the services requested, including to customers who are not responsible for the damage but use the service in conjunction with the person responsible for the damage

DMC World is not responsible for any incorrect completion of the booking form by the customer. Incorrect completion of the name may result in the border authorities refusing you entry into the country and refusing you accommodation

DMC World will not be liable to the customer for failure to issue a visa where required. In case of submission of regular documents and refusal of visa to the client, no refund will be made. In case of visa refusal due to submission of incomplete, inaccurate and false documents, previous misdemeanours of the tourist in the respective country, failure to comply with the deadlines for submission of the documents, as well as failure to appear for an interview at consular offices where required, the service will be cancelled and the stipulated penalties will be deducted.

DMC World is not responsible for the actions of border and customs authorities, airlines, bus and rail carriers and does not compensate customers, even if they miss part or even all of the service due to these actions.

For unsettled and other matters, the provisions of the Tourism Act, the Commercial Act and other applicable legislation of the Republic of Bulgaria shall apply.

The Customer makes a binding reservation of the Transport Services, choosing the place of departure, the destination, the date and time of departure and the method of payment.

If possible, the Customer may also select the locations along the route where the Transport Service Provider will make a stopover during the journey.

In the booking, the Customer must provide the following details of at least one Passenger: three names, address, telephone number and other mandatory details specified in the booking form or otherwise requested by DMC World, and indicate whether persons under 18 years of age will be travelling.

When completing the booking form, the Customer is required to provide information on whether there is a person among the travelling party who is disabled, uses special mobility aids or needs other special care during the journey, in order to be connected with an appropriate Transport Service Provider.

The exact time of the transport service is determined by the Customer when making the reservation. The Customer shall comply with the requirements of airlines regarding the technological time required for check-in.

DMC World shall not be liable to the Customer for any delay in the passenger’s departure from an address to an airport due to incorrect indication of the departure time, due to failure to account for the check-in time for a flight, or if the passenger has not indicated the correct time so as to arrive at the airport in time for check-in. The transport service provider shall also not be liable for any delay to the passenger due to the reason stated.

Reservations are confirmed in one of the following ways:

By e-mail

Via a mobile app like Viber or WhatsApp

By phone call or message (SMS).

Types of vehicles:

comfort class, business class, minivan, business van and premium van

Pricing – prices for transfer services vary depending on the type of vehicle and the mileage you need to travel. Transfers can be individual, group and VIP transfers.

Payment – when booking a confirmed transfer service, you are entitled to free cancellation unless otherwise stated in the specific terms and conditions

DMC World is not responsible for and will not refund any amounts if your card-issuing bank charges fees for a transfer. All fees and commissions in connection with payments by bank transfer are the responsibility of the User/Customer.

DMC World and the Transportation Service Provider reserve the right to refuse Transportation Service to any person who is visibly intoxicated or under the influence of drugs, or whose conduct is deemed to constitute a threat to the life and health of a person actually performing the Transportation Service or to the storage of the vehicle in its condition prior to the performance of the Transportation Service. In a case such as this, the Company will not reimburse the Customer for the amount paid by the Customer.

Rights and obligations of the User/Customer

The User/Customer is obliged to keep the vehicle in which he/she is travelling clean and undamaged.

The User/Customer is required to notify DMC World upon booking if they intend to travel with excess baggage such as ski equipment, golf clubs, surfboards, snowboards, bicycles, strollers, pets, etc. in order to secure a suitable vehicle. Failure to do so may result in DMC World cancelling the booking and the Supplier, or the driver, not providing the service if the number of passengers and their luggage does not meet the requirements for normal carriage. The User/Customer is not entitled to claim compensation.

Smoking, eating, drug use and consumption of alcoholic beverages are strictly prohibited in the vehicle.

When transporting domestic animals, the User/Customer should provide a cage for transporting animals. In the event of non-fulfilment of this obligation, the Supplier, respectively the driver, shall be entitled to refuse the carriage and shall not be liable for compensation for any damages resulting from non-fulfilment of the service.

In the event of problems with the provision of the service, the User/Customer is obliged to immediately notify DMC World at the telephone numbers indicated on the booking confirmation. Upon notification, DMC World will do its best to resolve the issue. If the User/Customer fails to notify DMC World, DMC World shall not be liable for any discrepancy between the service agreed and the service provided.

The User/Customer is obliged to specify in the reservation the number and type of child seats required for the trip. DMC World and the Supplier/Customer shall not be liable for any delay in the performance of the service in the event that the User/Customer has failed to notify DMC World of any details

If the User/Customer is detained for any reason by law enforcement authorities (border police, customs or airport security) and cannot continue his/her journey, the User/Customer is not entitled to compensation from DMC World nor from the Transport Service Provider.

The User/Customer is obliged to provide in the reservation information about the method of arrival in the country, the time of arrival and the means of transport – plane/train/bus by which he arrives. We shall not be liable and shall not be liable to pay any compensation for failure to provide the transfer service if the customer fails to provide this information on time or if it is inaccurate.

When requesting the service provided by the Provider, the User/Customer is obliged to comply with the information published on the website https://dmcworld.bg regarding the duration of the service for the respective destination and to allow sufficient time for its execution. The information published on the website is only indicative and for the convenience of the customer, we shall not be liable and shall not be liable to compensate the customer for any loss suffered by the customer (e.g. missed flight, train, bus) if the customer has not provided sufficient time for the execution of the transfer and all procedures related thereto.

If the Transport Service Provider does not arrive at the point of departure within 15 minutes after the agreed time, the User/Customer is obliged to contact DMC World to inform of the delay. If DMC World fails to provide the User/Customer with another Supplier or alternative transport within sixty minutes of notification, the User/Customer has the right to unilaterally cancel the service. In this event, the Transport Service Provider will refund to the User/Customer the full price paid for such cancelled service within 14 days of cancellation, and upon payment being made all property and non-property relations between the Supplier and the User/Customer shall be deemed to be settled.

Travellers must not interfere with the driving, or be rude or dismissive to the driver. Travellers are obliged to treat the vehicle with care so as not to damage or contaminate the vehicle.

In the event of any defects and damage to the interior and exterior of the vehicle caused by the User/Customer during the use of the service, the vehicle shall be sent for inspection to an authorized service center. DMC World shall, on behalf of the Supplier, notify the User/Customer at their email address specified in the booking of the cost of the damage and provide an invoice for the amount of the vehicle repairs. The User/Customer is obliged to pay the cost of the repair on the day of receipt if the service has not yet been performed in full, or within one week if performance has already been completed. The Supplier has the right to terminate the service without notice and at the expense of the User/Customer if the latter fails to pay in full the value of the damages and shortages caused by him to the vehicle.

Child travel safety: under Bulgarian law, children under 1 year of age who weigh less than 13 kg must travel in a rear-facing infant seat (BABY SEAT). Children over 1 year of age and weighing more than 8 kg must use a child seat (CHILD SEAT) and children less than 1.50 m tall and weighing more than 17 kg must use a seat belt with a special booster seat (BOOSTER SEAT). The Supplier offers standard child seats (CHILD SEAT) and booster seats (BOOSTER SEAT), but recommends that the User/Customer use their own personal protective equipment to ensure the maximum safety and comfort of the children travelling. The Supplier is not responsible for the quality and proper functioning of child seats. For hygiene and safety reasons, the Supplier does not offer infant seats (BABY SEAT).

Time and arrival: The service provider makes every effort to reach the destination at the agreed time. The Service Provider as well as DMC World do not guarantee the User/Customer the time of arrival to the agreed destinations.

The User’s/Customer’s luggage must be specified in advance, as the Service Provider makes a judgement, according to the size of the luggage and the number of passengers, as to which vehicle will be suitable for the journey. For any baggage that exceeds the pre-agreed baggage allowance, such as bicycles, disability aids, baby carriages, golf equipment, etc., the User/Customer should submit information explicitly when completing the booking form. If this is not done, the Service Provider is entitled to refuse the service and no refund of the fee paid will be due.

Terms and Conditions of Sale of Air Tickets

Except in the case of a travel package offered by DMC World, when brokering the purchase of an air ticket, the full amount is payable in full within 24 hours of confirmation.

It is absolutely essential that the names of the tourists are spelled correctly in Latin (as they appear on the identity document they will be travelling with.

In cases where an air ticket is purchased from so-called “Low Cost” airlines (Wizz Air, Ryan Air, Easy Jet, etc.), the amount due is prepaid in full in order to purchase the ticket.

When purchasing an airline ticket, the cancellation and penalty periods described in the DMC World terms and conditions are not valid.

In case of cancellation by the customer, if the ticket has already been purchased/issued, no refund will be given.

Each ticket is subject to specific conditions, penalties and change fees.

Airport and government (safety-related) charges are subject to reconfirmation until the ticket is issued. They go up and down, for which DMC World is not responsible.

DMC World is not responsible for the change of departure airport, flight time, change of aircraft type made by the airline. Similarly, the provision applies when another mode of transport is used

DMC Worls will recommend the most suitable catering company to offer a menu to suit the format of your event, whether it is indoor or outdoor. Venue services will be provided welcome, wardrobe, accommodation. A personal chef or bartender will be on hand to prepare and serve the food and drinks.

Booking conditions – the necessary information for catering are: date, place, time, number of guests, service time. According to the specifics of the event, we will offer you different types of menus and drinks, according to the preferences of your guests and a waiter to be at your disposal, depending on availability.

Payment – in order to confirm a catering service, payment is 100% in advance.

8.1 Cancellation Fees for Premium Services and Corporate Services:

up to 51 days before the date of travel without penalty

50 to 45 days before the date of travel – 10% of the total cost of the trip

45 to 30 days before the date of travel – 50% of the total cost of the trip

From 30 to 15 days before the date of travel – 80% of the total cost of the trip

for less than 15 days the date of travel – 100% of the total cost of the trip

Cancellation fees when booking a package service, including transport with vehicles up to 8+1 seats:

30 to 25 days prior to arrival – €50 to cover administrative costs

25 to 10 days prior to arrival – 25% of the total amount due.

from 10 to 05 days before arrival – 50% of the total amount due.

less than 05 days before the transfer time – we cannot refund the amount.

Cancellation fees when booking a package service including transport with vehicles over 8+1 seats (buses):

      from 45 to 30 days before arrival – €100 to cover administrative costs

30 to 15 days prior to arrival – 35% of the total amount due.

from 15 to 07 days before arrival – 80% of the total amount due.

07 days to arrival date – we cannot refund

Cancellation fees when booking a package service, including transport in vehicles with more than 9 seats (minibus and bus), as well as during special events and periods (exhibitions, high season, public holidays)

from 60 to 45 days before arrival – EUR 200 to cover administrative costs

45 to 30 days prior to arrival – 50% of the total amount due.

30 to 14 days prior to arrival – 80% of the total amount due.

from 14 days to arrival date – we cannot refund.

Cancellation fees for booking individual transport/transfer services with vehicles up to 8+1 seats only:

Between 8 and 10 days before the date and time of the transfer, the User/Customer pays 10% of the cost of the service

Between 5 and 8 days before the date and time of the transfer, the User/Customer pays 30% of the cost of the service

Between 3 and 5 days before the date and time of the transfer, the User/Customer pays 50% of the cost of the service

Between 24 to 72 hours before the date and time of the transfer, the User/Customer pays 80% of the cost of the service

If less than 24 hours remain until the time of transfer, the User/Customer pays 100% of the cost of the service.

The above conditions apply if the Package Contract does not specify other different conditions for cancellation/cancellation of the package.

The terms and conditions described in this document do NOT apply to individual bookings under the EARLY BOOKINGS, LAST MINUTE, Easter, Christmas and New Year offers. In the event of cancellation/ cancellation of a confirmed booking for hotel accommodation and/or other Travel Service under the EARLY BOOKINGS, LAST MINUTE, Easter, Christmas and New Year offers. special conditions apply.

The cancellation fee for Christmas and New Year offers, i.e. for the period from 24 December to 10 January, is from 90% to 100% of the total package price of the booked package, regardless of the deadline for cancellation. The specific amount of the cancellation fee is specified in the Package Contract. The above conditions apply if the Package Contract does not specify other different conditions for cancellation of the package.

The term and amount of the cancellation/booking cancellation fee for “EARLY BOOKINGS”, “SPECIAL OFFER” LAST MINUTE and Easter Holiday offers are as follows:

up to 51 days prior to the date of commencement of the tour package – cancellation fee equal to 50% of the total package price of the booked tour package;

from 50 to 0 days before the date of commencement of the tour package – cancellation fee equal to 100% of the total package price of the booked tour package

RIGHTS AND OBLIGATIONS OF THE PARTIES

Rights and obligations of the TOUR OPERATOR

The TOUR OPERATOR shall be fully responsible for the performance of all tourist services included in the program/tour package in accordance with the terms and conditions of the specifically concluded Package Contract.

The TOUR OPERATOR has concluded insurance “Liability of the Tour Operator” under Art. 1 of the Tourism Act.

The TOUR OPERATOR shall provide the possibility of concluding a voluntary or compulsory insurance contract to cover the costs of assistance, including repatriation of the traveller in case of accident, illness or death, by providing the USER with an original insurance policy before the start of the trip, unless the USER has independently concluded this type of insurance and its term covers the duration of the travel package. The terms and conditions of the insurance are set out in the Insurer’s General Conditions and the insurance policy.

By this clause, on the basis of Art. The TOUR OPERATOR reserves the right to unilaterally modify clauses in the package contract when the change is insignificant, and subject to the obligation of the TOUR OPERATOR to inform the USER of the change in a clear, understandable and visible manner on a durable medium. The TOUR OPERATOR reserves the right to change the indicated hotels, dining or entertainment establishments with equivalent ones of the same category. Such change shall be deemed to be minor and the customer shall not be entitled to cancel the trip. In the event that the TOUR OPERATOR makes a significant change to any of the material provisions of the Package Contract, the TOUR OPERATOR shall immediately notify the CUSTOMER. Acceptance of the changes shall be evidenced by an additional agreement to the contract.

According to the Tourism Act, the TOUR OPERATOR shall not be liable for damages caused by non-performance or inaccurate performance of the Package Contract due to: 1. Actions of a third party unrelated to the performance of the contract, which cannot be foreseen or avoided;

The TOUR OPERATOR shall not be liable for any damages caused by non-performance or inaccurate performance of the Package Contract due to the USER. The TOUR OPERATOR shall not be liable for and shall not owe any compensation, damages or penalties due to hooliganism on the part of the USER.

The TOUR OPERATOR is not liable for cancellation of the trip due to illness or other personal reasons related to the USER, he loses the amounts paid to the TOUR OPERATOR in accordance with the terms of cancellation, respectively due payment of these amounts in the event of non-payment.

The TOUR OPERATOR shall not be liable in case of refusal of the border authorities to allow entry of the USER to the territory of the respective country and shall not be liable to refund the price paid for the package.

The TOUR OPERATOR is not responsible for services that are not included in the tourist package but are selected, organized or paid for by the USER during the tourist package.

The TOUR OPERATOR shall not be liable to the CLIENT for storage of personal luggage, money, valuables, documents, etc., including those left at the accommodation.

The TOUR OPERATOR shall not be liable for and shall not compensate the USER who has opted out of certain services or has voluntarily deviated from the program and has therefore missed services under the previously agreed program.

In cases where the liability of the contractors of the TOUR OPERATOR for damages caused by the non-performance of the services is limited by international treaties ratified, promulgated in the Official Gazette and in force for the Republic of Bulgaria, the liability of the TOUR OPERATOR shall be within these limits.

Where the liability of the providers of tourist services included in the Package Contract is not determined by international treaties ratified, promulgated in the State Gazette and in force for the Republic of Bulgaria, or where these international treaties do not limit the amount of compensation payable by the provider, the liability of the TOUR OPERATOR for damages caused to the USER as a result of non-performance or inaccurate performance of the Package Contract shall be limited to three times the price of the respective package. This provision shall not apply in cases of personal injury to the USER and in cases of damage caused intentionally or through negligence.

In the event that the USER fails to make payments due to the TOUR OPERATOR within the established deadlines, the TOUR OPERATOR shall be deemed to have the right to cancel the reservation without notice and without penalty or refund of any amounts paid to date.

The TOUR OPERATOR has the right at any time during the trip to unilaterally refuse to provide part of the Services included in the package without penalty or compensation in the event that the CONSUMER’s behavior creates a serious risk to the health, safety or comfort of other users, employees or contractors of the TOUR OPERATOR or government or municipal officials in the host country or the successful continuation of the trip.

The TOUR OPERATOR shall not be liable for fines and other penalties imposed on the USER by authorized persons both in R. Bulgaria and in the host country, for offences committed by the USER, such as littering in an unauthorized place, smoking in a public place, indecent appearance and/or behavior, failure to comply with traffic rules, etc. similar.

The TOUR OPERATOR shall not be liable and shall not be obliged to reimburse additional costs to the USER in cases of missed transfers and excursions due to his delays, as well as for services not provided due to inadequate condition or appearance. In the event that, due to the above reasons, additional costs are incurred by the USER or the TOUR OPERATOR, these shall be borne in full by the USER.

Each USER accompanying a minor shall be jointly and severally liable for the conduct and welfare of all minors traveling with him/her for the duration of the relevant Service/Package Contract and expressly accepts these Terms and Conditions and the specific terms of a Service on behalf of the minor, including all inherent risks and limitations of liability. The USER also assumes all responsibility for the supervision of the minor it accompanies, and the TOUR OPERATOR and its employees and/or agents expressly disclaim any and all liability regarding the care, control and/or supervision of the minor.

All instructions from the representatives of the TOUR OPERATOR, such as employees, instructors, guides, etc., are binding and binding on the USER. The TOUR OPERATOR may require the USER to perform certain actions in order to comply with the requirements concerning the organization, safety and security or legal ones concerning the execution of the tourist package.

The TOUR OPERATOR is obliged to provide, without unreasonable delay, appropriate assistance to a CONSUMER in difficulty, including in the cases referred to in Art. Where the HARDSHIP OF THE PASSENGER is caused by the intention or negligence of the PASSENGER, the TOUR OPERATOR may charge the traveller a reasonable fee for the assistance provided.

Any changes to the concluded Package Contract (change of passport details, transfer of travel dates, replacement of services, etc.) shall be made only with the written consent of the TOUR OPERATOR. In case of such changes, the TOUR OPERATOR reserves the right to recalculate the cost of organizing and providing the travel package and to require additional payment from the USER.

Rights and obligations of the USER

The CLIENT is obliged to notify the TOUR OPERATOR immediately if there is a change of e-mail/phone number specified in the Package Contract.

The USER is obliged to pay for the requested Services under the Package Contract in full and within the time limits set out in the Contract.

The USER is obliged to observe all dates, times and places of departure as specified by the TOUR OPERATOR.

The USER shall comply with all instructions given by the TOUR OPERATOR, its employees and third parties to whom the TOUR OPERATOR has entrusted the performance of the Service.

USER shall ensure that all necessary prerequisites and insurance requirements are met prior to participation in the Service. Insurances taken out by the TOUR OPERATOR on behalf of the USER are mentioned in each offer for the Service.

The USER has the right to cancel a Service after its reservation and before its execution begins. Where the USER cancels the Service, the USER shall pay a cancellation/cancellation fee calculated on the basis of the time at which the contract is terminated prior to the commencement of the Service and the expected cost and revenue savings from alternative provision of the Travel Services as set out in the General Terms and Conditions and the Travel Package Contract.

The USER shall have the right to cancel the Package Contract before the commencement of the Service and, depending on the cancellation terms, may or may not pay a fee.

In the event that the USER is prevented from participating in a booked Service for any reason, he may transfer his reservation (if the terms of the Service permit such a change) to another person who meets all the requirements applicable to the reservation, for which he shall give notice to the TOUR OPERATOR in a durable medium not later than 14 (fourteen) days before the commencement of the Service. The transferring USER and the transferee shall be jointly and severally liable for the payment of the full price of the Service and for the payment of any additional costs, charges, levies and other incidental expenses that may arise as a result of the transfer of the booking. Upon assignment, all rights and obligations under these Terms and Conditions shall immediately be assumed by the assignee.

The TOUR OPERATOR shall inform the USER of the actual costs of the transfer and shall provide the USER with evidence of the costs, charges or other additional costs arising from the transfer of the Contract.

The USER shall comply with the laws of the country to which he/she is travelling.

The USER who intends to travel and stay in countries with increased risk of infectious diseases is obliged to undergo appropriate prophylaxis in accordance with international medical requirements.

The USER is obliged to provide the necessary personal documents with the appropriate validity for travel outside the country – an ID card with validity until the end date of the trip and an international passport with validity of 6 months from the end date of the trip, including all visas, permits, certificates, etc., and these documents must be available at all times. The USER is solely responsible for securing all necessary documents prior to the commencement of the Service and will be liable for any consequences arising from their absence or non-compliance with the established requirements.

For children under 18 travelling alone or with one of the parents – in addition to the required ID, a notarised declaration from one/both parents that they agree to their child travelling abroad, with the notary’s telephone number, is required. The original and 2 copies of the declaration should be carried during the trip.

The CLIENT has the right to unilaterally cancel the Package Contract (cancellation/cancellation of reservation) at his/her own request in case of a reservation made at regular prices, by paying to the TOUR OPERATOR the cancellation fees described in paragraph 8 of the General Conditions – Cancellation Fees.

The above conditions apply if the Package Contract does not specify other different conditions for cancellation/cancellation of the package.

The CLIENT shall be liable to pay the actual costs incurred by the TOUR OPERATOR related to the cancellation of the reservation, such as fines from travel service providers and others, in excess of the cancellation fee.

Changing the name, date or hotel in a reservation for EARLY BOOKINGS, LAST MINUTE, Easter, Christmas and New Year offers is NOT ALLOWED.

If the USER voluntarily cancels his/her trip, during its duration, all additional costs, including transport costs, are at his/her own expense. In this case, the USER may not claim a refund of any part of the cost of the Services requested but not used.
